Effective Date: 17th October 2023
1. Acceptance of Terms: By engaging in activities related to the Private Trusts Direct (hereinafter referred to as the “Foundation Trust”), you (hereinafter referred to as the “Beneficiary”) acknowledge and agree to these Equitable Terms of Service. If you do not agree with these terms, please refrain from engaging in any activities related to the Foundation Trust.
2. Foundation Trust Description: The Foundation Trust is established for the provision of education, documentation and support in Trusts Law.
3. Sovereign Status Acknowledgement: Beneficiary acknowledges their sovereign status and their recognition of equitable remedies, specifically the possibility of specific performance, breach of fiduciary duty, and rescission, in the event of a breach of the Foundation Trust agreement.
4. Engagement with the Foundation Trust: Beneficiary agrees to engage with the Foundation Trust in accordance with applicable laws, regulations, and these Equitable Terms of Service. Beneficiary is solely responsible for their actions and commitments to the Foundation Trust.
5. Equitable Remedies: In the event of a breach of the Foundation Trust agreement, Beneficiary agrees that the Foundation Trust may seek equitable remedies, including but not limited to specific performance and rescission, to enforce the terms of the agreement. Beneficiary consents to the authority of a court of equity for the purpose of enforcing equitable remedies.
6. Dispute Resolution: In the event of a dispute or breach of the Foundation Trust agreement, both the Beneficiary and the Foundation Trust agree to submit to the jurisdiction of a court of equity for the purpose of enforcing equitable remedies. The parties agree to cooperate in good faith with any equitable remedies imposed by the court.
7. Governing Law: These Equitable Terms of Service shall be governed by and construed in accordance with the laws of Equity.
8. Limitation of Liability: Beneficiary acknowledges that the Foundation Trust is not liable for any damages, losses, or claims arising from engagement with the Foundation Trust and that the Beneficiary assumes full responsibility for their actions.
9. Modifications to Terms: The Foundation Trust reserves the right to update or modify these Equitable Terms of Service at any time without prior notice. Beneficiary’s continued engagement with the Foundation Trust after such changes constitutes acceptance of the modified terms.
10. Entire Agreement: These Equitable Terms of Service constitute the entire understanding between Beneficiary and the Foundation Trust and supersede any prior agreements or understandings, whether written or oral.

By engaging in activities related to the Foundation Trust, Beneficiary acknowledges and agrees to these Equitable Terms of Service in their entirety.
